These Terms of Service ("Terms") are a legally binding agreement between you and Lumin Marketing Group ("we," "us," or "our"), based in Edmonton, Alberta, Canada. These Terms govern your access to and use of the PKTD™ mobile application and related services.

Please read these Terms carefully. If you do not agree to these Terms, do not download, install, access, or use PKTD™.

1. The Service

PKTD™ is an iOS receipt scanning and expense organization app. Depending on your device, settings, permissions, and subscription status, PKTD™ may include:

PKTD™ is a software tool for organization and convenience. It is not a bank, accounting firm, tax preparer, law firm, financial advisor, bookkeeping service, or regulated financial institution.

We may modify, add, remove, suspend, or discontinue features from time to time. We do not guarantee that every feature will be available at all times, on every device, in every region, or for every user.

2. Eligibility and Age Requirement

You must be at least eighteen (18) years old and have the legal capacity to enter into these Terms. If the age of majority in your jurisdiction is older than 18, you must be at least that age.

PKTD™ handles receipt, spending, tax-context, and business-expense information. Because of the financial nature of this information, PKTD™ is intended only for adults.

We do not knowingly allow individuals under 18 to use PKTD™. If you believe someone under 18 is using PKTD™, contact us at legal@pktd.ca.

3. Accounts, Device Access, and Apple Services

PKTD™ currently does not require a PKTD™ account or separate PKTD™ sign-in to use the app.

Some PKTD™ functionality depends on services controlled by Apple or your device, such as:

You are responsible for maintaining access to your device, Apple ID, iCloud settings, subscription settings, backups, and local data. Deleting the app, disabling iCloud, changing Apple ID settings, replacing your device, or erasing local storage may affect your ability to access data.

4. Subscriptions, Trials, and Payments

PKTD™ may offer free access, limited free features, trial access, paid subscription features, promotional access, or beta/tester access. The availability and limits of these offers may change over time.

All paid subscriptions and in-app purchases are handled through Apple's App Store and StoreKit. We do not directly process your payment card details.

When you purchase a subscription through Apple:

Any product names, prices, trial terms, or subscription benefits shown inside PKTD™, on the App Store, or in purchase sheets are subject to Apple's purchase confirmation and the terms shown at the time of purchase.

Promo, referral, invite, or beta features may be changed, limited, revoked, or discontinued. Promotional access has no cash value and may not be transferred, sold, or redeemed except as expressly allowed in the app.

5. AI Features and Important Disclaimers

PKTD™ is not financial, tax, accounting, legal, or bookkeeping advice. AI-generated output may be incomplete, incorrect, or misleading and must be reviewed by you.

PKTD™ includes optional AI-assisted features. AI parsing and Ledger chat require your consent before use. When enabled, PKTD™ may send receipt text, extracted fields, your Ledger messages, and app-generated context through PKTD™'s backend to OpenAI or other service providers as described in our Privacy Policy. Receipt images are not sent for AI parsing.

AI output can be wrong. This includes extracted merchants, dates, totals, taxes, tips, line items, categories, tax fields, mileage context, warranty details, business labels, summaries, charts, insights, and Ledger chat responses.

You are responsible for reviewing, verifying, correcting, and deciding whether to rely on any PKTD™ output. Do not rely on PKTD™ output as your only source for financial, tax, legal, accounting, bookkeeping, employment, reimbursement, insurance, audit, or compliance decisions.

Consult a qualified professional before using PKTD™ output for tax filings, business records, reimbursements, audits, legal matters, or other important decisions.

6. Your Content

"Your Content" means receipt images, OCR text, receipt fields, categories, custom categories, notes, corrections, tax fields, warranty information, business labels, trip and mileage data, Ledger messages, voice dictation text, exported files, and other content that you provide to or create in PKTD™.

You retain ownership of Your Content. We do not claim ownership of it.

You grant us a limited, non-exclusive, worldwide license to process Your Content only as needed to provide, maintain, protect, troubleshoot, and improve PKTD™, including:

Receipt images are stored on your device and may sync to your private iCloud if you enable iCloud sync. We do not receive receipt images for AI parsing. If you choose to share images or exports with another app, support channel, cloud service, or person, that sharing is controlled by your action and the receiving service.

When you delete local data in PKTD™, the deletion applies to the data controlled by the app on your device and, where applicable, synced iCloud data. Data that was already transmitted for AI processing, security, support, operational, or legal purposes may be retained by us or our service providers as described in the Privacy Policy and applicable provider terms.

7. AI Training and Model Improvement

PKTD™ does not currently include an in-app AI training opt-in toggle, and we do not use your receipt images, receipt text, Ledger messages, or other personal app content to train PKTD™-specific AI models.

OpenAI states that API data is not used to train or improve OpenAI models unless the API customer opts in. PKTD™ has not built a user-facing opt-in for using your personal receipt content to train AI models. This does not prevent us or our providers from processing limited logs or metadata for security, abuse prevention, reliability, debugging, legal compliance, or operational purposes as described in the Privacy Policy and provider documentation.

If we introduce a feature that would use personal app content for model training or product improvement beyond the processing described in these Terms and the Privacy Policy, we will update the applicable disclosures and request consent where required.

8. Privacy and Data Handling

Our Privacy Policy explains how PKTD™ handles data. In summary:

9. Acceptable Use

You agree not to:

We may investigate suspected violations and may suspend, limit, or terminate access to PKTD™ or backend features where needed to protect users, the Service, our providers, or legal rights.

10. Intellectual Property

PKTD™, including its software, design, interface, graphics, brand, trademarks, documentation, prompts, workflows, and other materials, is owned by Lumin Marketing Group or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PKTD™ on Apple-branded devices that you own or control, as permitted by Apple's App Store rules and these Terms.

You may not copy, distribute, sell, lease, sublicense, publicly display, or create derivative works from PKTD™ except as expressly allowed by these Terms or applicable law.

If you send us feedback, ideas, suggestions, or bug reports, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use them without restriction or compensation to you.

11. Records, Taxes, Mileage, and Business Use

PKTD™ can help organize receipts, tax fields, warranty details, business labels, recurring expenses, trip and mileage information, and exports. These features are convenience tools only.

You are responsible for:

PKTD™ does not guarantee that its categories, tax fields, mileage calculations, trip records, maps, exports, or AI suggestions satisfy any tax authority, employer, insurer, court, regulator, accountant, or auditor.

12. Third-Party Services

PKTD™ depends on third-party services and platforms, including Apple services, OpenAI, Firebase, Cloudflare, and other providers that may be added or changed over time. Your use of PKTD™ may also be subject to third-party terms and privacy policies.

We are not responsible for third-party services, outages, account restrictions, pricing changes, provider policy changes, or data handling outside our control. We may change service providers when needed for reliability, security, compliance, cost, or product reasons.

13. Disclaimers

PKTD™ is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and error-free operation.

We do not warrant that:

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.

14. Limitation of Liability

To the maximum extent permitted by law, Lumin Marketing Group and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, revenue, goodwill, data, business opportunities, or financial records.

This limitation includes damages arising from:

To the maximum extent permitted by law, our total aggregate liability for all claims arising from or relating to PKTD™ or these Terms will not exceed the greater of: (a) the amount you paid to Lumin Marketing Group through Apple for PKTD™ subscriptions in the twelve (12) months before the event giving rise to the claim; or (b) fifty Canadian dollars ($50 CAD).

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Lumin Marketing Group and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from or related to:

We reserve the right to control the defense of any matter subject to indemnification. You agree to cooperate with us in that defense.

16. Suspension and Termination

You may stop using PKTD™ at any time by deleting the app. Deleting the app does not cancel an Apple subscription; you must cancel through your Apple ID subscription settings.

We may suspend, restrict, or terminate access to PKTD™ or backend features if:

After termination, your license to use PKTD™ ends. Sections that by their nature should survive will survive, including sections about AI disclaimers, Your Content, privacy, acceptable use, intellectual property, records and taxes, third-party services, disclaimers, limitation of liability, indemnification, disputes, governing law, and Apple terms.

17. Changes to These Terms

We may update these Terms to reflect changes in PKTD™, law, provider requirements, Apple rules, subscriptions, privacy practices, security needs, or business operations.

For material changes, we will provide notice as required by law, which may include in-app notice, App Store listing updates, website updates, or other reasonable methods. Your continued use of PKTD™ after updated Terms become effective means you accept the updated Terms.

If you do not agree to updated Terms, stop using PKTD™ and cancel any active subscription through Apple.

18. Dispute Resolution

Please contact us first at legal@pktd.ca so we can try to resolve concerns informally.

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction require otherwise.

Subject to mandatory consumer protection rights that cannot be waived, disputes arising from or relating to these Terms or PKTD™ will be brought in the courts located in Edmonton, Alberta, Canada, and you consent to the jurisdiction of those courts.

Nothing in these Terms limits rights you may have under mandatory consumer protection, privacy, subscription, or app marketplace laws that cannot be waived by contract.

19. General Terms

These Terms, together with the Privacy Policy and any terms shown in Apple's purchase flow, are the entire agreement between you and Lumin Marketing Group for PKTD™.

If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remaining parts will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.

We are not responsible for delay or failure caused by events beyond our reasonable control, including outages, device or platform issues, natural disasters, labor disputes, government actions, war, terrorism, internet failures, or third-party service failures.

Section headings are for convenience only and do not affect interpretation.

These Terms are written in English. If translated, the English version controls unless applicable law requires otherwise.

20. Apple Licensed Application Terms
